Service agreement and conditions — Notice of liability limitations

For this agreement, the company shall be understood as: ZIP Cargo. ZIP Cargo's services are reserved for and directed at persons with legal capacity to contract who are over 18 years of age. By using our services or signing this agreement, you accept all the terms set forth herein.

General information

ZIP Cargo's services are reserved for and directed at persons with legal capacity to contract who are over 18 years of age.

Transportation — Warsaw Convention notice

If the air transportation of your goods or document includes a destination or final stop in a country different from the country of departure, some rules of the 1929 Warsaw Convention will apply.

By signing this document, you agree that the standard terms of ZIP Cargo and its affiliates limiting liability for damages, losses, or delays apply to your goods. Our liability for delays will be limited to a one-time reimbursement of transportation costs, and our liability for damage or loss shall not exceed US $100.00 or US $5.07 per pound, pursuant to the 1929 International Warsaw Convention.

Cargo liability

ZIP Cargo is responsible for all cargo received at our Miami warehouse that generates a record in our systems, until delivery at one of our offices. We are not responsible for cargo allegedly delivered that cannot be corroborated by the delivery signature of our staff.

Merchandise delivered at the main entrance of the establishment and not securely at the loading bay will not have any guarantee or backing from ZIP Cargo.

Non-assumed liabilities

In no event will we be liable for any damage, whether direct, incidental, special, or consequential, exceeding the declared value of the goods for transportation, including loss of income or profits, unless caused by our intentional misconduct or gross negligence.

We will not be liable for loss, damage, or delay caused by events beyond our control: acts of God, air hazards, weather conditions, mechanical delays, acts of public enemies, wars, strikes, civil disturbances, or acts of governmental authorities.

Claims

To process a claim for goods with evident damage, missing goods with a Miami arrival record, or confirmed shortage, the account holder must submit a detailed claim letter, return the goods to ZIP Cargo, and provide the invoice. The claim will be processed at the branch. No claim will be accepted for goods that show evidence of tampering (opened by customs).

ZIP Cargo may take 7 to 21 days to respond to the claim. The goods must have been pre-alerted at least 48 hours before arrival at the main warehouse, and the ZIP Cargo Protect service must have been requested and paid for in advance.

Without ZIP Cargo Protect, the claim is governed by the 1929 Warsaw Convention with a minimum deductible of $20.00. No claims will be accepted after 24 hours of merchandise delivery with no evident signs of tampering.

Pre-alert

The pre-alert is a tool we use to control cargo received at our warehouses. Without a pre-alert we have no control over the received goods. All pre-alerts must be submitted at least 48 hours before arrival at the main warehouse. Failure to comply will invalidate any subsequent claim.

Online shopping service

ZIP Cargo offers a shopping and/or credit card service for clients who do not have one. The client must send the product link with details and specifications. ZIP Cargo will not be responsible for inconsistencies, errors, or defects in the purchased product.

The client must notify us within no more than 24 hours and return the goods to process a claim with the supplier.

ZIP Cargo Protect

Coverage for all merchandise from its arrival at the Miami warehouse until delivery to the client in Panama.

• $5.00 for merchandise declared with a value up to $99.99 • 5% for merchandise valued at $100 or more (air) • 5% for sea merchandise valued above $100.00

The client must include the invoice and tracking number in the pre-alert and pay for the service in advance.

Repacking

If the merchandise is not in optimal condition for the flight, we will proceed to perform external repacking without handling the contents. This involves a fixed cost that will be communicated to the client. If the client does not accept the charges and the goods are shipped as received, ZIP Cargo will not be responsible for any resulting damage.

Abandoned packages

ZIP Cargo reserves the right to dispose of packages that have not been picked up from its facilities within 30 days after the client has been contacted. Packages that remain in Miami due to lack of client information will be disposed of after 2 months of receipt.

Right to inspect

By this agreement, you authorize ZIP Cargo to inspect all merchandise at the request of the United States National Customs Authority. You also authorize opening and inspecting your merchandise at the request of governmental authorities at destination at any time, before or after shipment.

Unacceptable and prohibited items

We do not accept merchandise considered hazardous material by the DOT, IATA, or ICAO. This includes: animals, alcoholic beverages, live plants, firearms, perishable goods, chemicals, radioactive or flammable materials, precious stones or high-value jewelry, lottery tickets, cash, among others.

Restricted items include: those containing alcohol (flammable cosmetics or chemicals), items under air pressure (airbags, shock absorbers, aerosols), as well as animal or human consumables requiring special procedures.

Customs clearance

By delivering your goods to us, you appoint us as your exclusive agent to carry out customs clearance. Goods will be assessed with the applicable tariffs based on the documentation you provide. Tax and customs duty payments will not be refunded under any circumstances.

Payment responsibility

You will be responsible for all charges incurred, including transportation, handling, customs assessments, government fees and fines, taxes, and legal costs.

• Accounts unpaid within the month enter "Suspended" status. • Packages not picked up within 15 days of branch receipt: $1.00/day/package, maximum $25.00. • Returned checks: commission of $35.00 to $50.00.

Rates

Freight rates are based on whole pounds. The greater weight between actual weight and volumetric weight is charged. Any package in which one side exceeds 50 inches is billed by volumetric weight: (height × length × width) / 166.

Personal data

By registering your data with ZIP Cargo, you authorize ZIP Cargo to collect, store, and use this data to provide information about promotions, events, surveys, and services via email, SMS, WhatsApp, and social media.

You have the right to access, update, and correct your personal data, and may request deletion of your data when applicable.

Modifications

The company reserves the right to change, modify, add, or remove this membership agreement. For the interpretation and fulfillment of this contract, the parties submit to the laws of the Republic of Panama and the jurisdiction of its courts.
